The learned Sub Judge had held that the defendant was liable to repay the sum of Rs.3,88,000/- since the defendant had not taken out a plea in his written statement that the defendant had handed over a blank/ unsigned promissory note to the plaintiff’s husband. On the contrary, the defence taken was that the promissory note has been created by forgery. The Trial Court has also taken note of the fact that the defendant has admitted his signature in the promissory note.
