The learned counsel for the petitioner would submit that the petitioner is the organiser of the temple festival of Sri Muthala Parameswari Ambal Temple and they decided to celebrate temple festival on 28.03.2025 and also decided to conduct a dance programme on 29.03.2025. For that, they approached the first respondent for granting of permission and the same was rejected on 22.03.2025 by citing the reasons of the law and order issue and now, public examinations are going on and the abovesaid place earmarked for conducting dance programme is _____________ https://www.mhc.tn.gov.in/judis ( Uploaded on: 28/03/2025 09:13:44 pm ) W.P(MD) NO.8546 of 2025 adjacent to the national highway. Therefore, it will cause traffic congestion to the public. The abovesaid grounds are not reasonable. The learned counsel for the petitioner also would submit that the petitioner undertakes that the dance programme will be conducted without affecting the traffic and law and order. Therefore, the order passed by the first respondent is liable to be set aside.

The learned Additional Public Prosecutor (Crl side) for the respondents would submit that the petitioner sent a representation, dated 22.03.2025 for conducting dance programme and the same was rejected through the order, dated 23.03.2025 by the first respondent by citing said reasons. Therefore, if the petitioner are permitted to conduct dance programme, it will affect the law and order and traffic congestion. Therefore, the petition is liable to be dismissed.

4. Heard both sides and perused the records.

The petitioner, along with villagers decided to conduct festival for the Sri Muthala Parameswari Ambal Temple from 28.03.2025 to 29.03.2025 and also they decided to conduct a dance programme on _____________ https://www.mhc.tn.gov.in/judis ( Uploaded on: 28/03/2025 09:13:44 pm ) W.P(MD) NO.8546 of 2025 29.03.2025 at five corners Lana Mahal, near Iyyappan Temple. The first respondent declined to grant permission on the ground that the above said place is very near to the national highway and neighbouring villagers also would gather and thereby, there is a chance for law and order issue. Since the festival is scheduled to be held on 29.03.2025, the villagers also decided to conduct dance programme and the same is one of the cultural programme, the respondents cannot deny the same only on the ground of the law and order issue. Now, the petitioner also assured before this Court that without disturbing traffic and the public movement, they will conduct the dance programme and there may not be any law and order only because of this event. Therefore, considering the abovesaid reasons, this Court is inclined to set aside the order passed by the first respondent.

Accordingly, this petition is allowed and the order passed by the first respondent in Na.Ka.No.254/Ka.Thu.Ka-Parama/Camp/2025, dated 22.03.2025 is set aside and the respondents are directed to grant permission to conduct dance programme by imposing appropriate conditions in accordance with law.
