793. Further, strong reliance has been placed by the learned Government Advocate upon another decision of the Supreme Court in the case of Election Commission of India & Anr. Vs. Dr. Subramanian Swamy & Anr., reported in AIR 1996 SC 1810 wherein the Apex Court considered the 'doctrine of necessity' and laid down the principle at paragraphs 13,14 and 15.
