          आगे रिपोर्ट में पेज 492 में पैरा 16.6 में लिखा है, “It cannot be assumed even for a moment that L.K. Advani, Atal Bihari Vajpayee or Murli Manohar Joshi did not know the designs of the Sangh Parivar”.  रिपोर्ट की इन पंक्तियों से पूरी तरह साफ है कि आडवाणी जी, मुरली मनोहर जोशी जी और सर्वमान्य नेता वाजपेयी जी के खिलाफ दोषारोपण जो किया गया है, वह तथ्यों के आधार पर, फैक्ट्स के आधार पर नहीं किया गया है, बल्कि केवल एजम्पशन के आधार पर, अनुमान के आधार पर किया गया है।  उनकी रिपोर्ट से ही मैंने कांक्ल्यूजन निकाला है।  ...( व्यवधान)  हमारा कहना है कि किसी भी कमीशन अथवा किसी भी व्यक्ति को यदि किसी घटना की जांच करनी चाहिए तो जांच का आधार इनडक्टिव लॉजिक होना चाहिए यानी जो तथ्य मिलें, जो साक्ष्य मिलें, उनके अनुसार निष्कर्ष या किसी कनक्लूज़न पर पहुंचा जाए। लेकिन लिब्रहान कमीशन ने जो कुछ भी लिखा है, वह इनडक्टिव लॉजिक के आधार पर नहीं लिखा है बल्कि डिडक्टिव लॉजिक के आधार पर लिखा है। उनका पहले से डिज़ायर्ड कनक्लूज़न था, पहले से तय कर लिया था कि हमें किस निष्कर्ष पर पहुंचना है। उस हिसाब से सारे तथ्य और साक्ष्य उन्होंने उसमें डालने की कोशिश की है।

          उस समय आक्रोशित कारसेवकों की मनोदशा की मैं यहां पर चर्चा करना चाहूंगा। इसलिए चर्चा करना चाहूंगा क्योंकि लिब्रहान कमीशन ने अपनी रिपोर्ट के पेज 253 के पैरा 44.12 पर लिखा है “Some defiant Karsevaks pushed Shri L. K. Advani, Murli Manohar Joshi and Vinay Katiyar and captured the platform of Karseva, and they were finally taken out by Swayamsevak of RSS.” साफ-साफ लिखा है कि आडवाणी जी बार-बार अपील कर रहे थे। उसके बाद भी वहां पर जो आक्रोशित लोग थे, उन्होंने इनको ठेल कर वहां से हटा दिया, उसके बाद भी इनको इलहाम हो रहा है।  उसके बाद इन्हें इलम हो रहा है कि आडवाणी जी, अटल बिहारी वाजपेयी जी और विनय कटियार का इसमें हाथ है। ...( व्यवधान) मैं आपके माध्यम से, सरकार से अपील करना चाहता हूं कि साप्रदायिक सौहार्द्र होना चाहिए, यह भारतीय जनता पार्टी भी चाहती है। लेकिन मैजोरिटी और माइनोरिटी के नाम पर यदि आप किसी को अपीज करने की कोशिश करेंगे तो इससे साप्रदायिक सौहार्द्र पैदा नहीं होता है वरन् इससे साप्रदायिक द्वेष पैदा होता है। हम एक सिंद्धांत में विश्वास करते हैं कि “justice to all and appeasement of none”  और इतिहास से हमें सबक लेना चाहिए कि कैसे 1947 में मजहब के नाम पर भारत-माता के दो टुकड़े हो गये। इसलिए फिर से वे स्थितियां पैदा न हों, यह सबक लेने की आवश्यकता है। ...( व्यवधान) मैं इस रिपोर्ट के बारे में कहना चाहूंगा कि The Report is totally baseless, biased, prejudiced and meticulously designed to target some persons, some political parties and some organizations.  लगता है कि आज तक हम अपनी कोलोनियल माइंड सेट की विरासत में जी रहे हैं। ढांचे के विध्वंस का कारण दशकों की गतिविधि में नहीं, घंटों की गतिविधियों में तलाशने की कोशिश की गयी है। जैसे कोई रैवेन्यू केस होता है वैसे ही इस सरकार के द्वारा इस मामले को सुलझाने की कोशिश की जा रही है।  कभी राम के ऊपर बैन कर दिया जाता है, और रामसेतू के बारे में जो कुछ कहा गया कि नल-नील इंजीनियर कहां थे बताओं? स्वभाविक रूप से इससे आक्रोश पैदा होता है। मैं यह कहना चाहता हूं कि सेक्युलरिस्ट शब्द से भी भ्रम पैदा होता है। मेरी पूरी बात सुन लीजिएगा, तब रिएक्ट कीजिएगा। सेक्युलर शब्द से एक बहुत बड़ा भ्रम पैदा होता है, जब हम धर्म को सेक्युलरिज्म के खिलाफ मान लेते हैं, लेकिन ऐसा नहीं है। व्यक्ति सेक्युलर भी हो सकता है, अपने धर्म को मानने वाला भी हो सकता है और सेक्युलरिज्म के अर्थ में धर्म-निरपेक्ष शब्द का प्रयोग प्रतिबंधित किया जाना चाहिए क्योंकि जो हमारे संविधान का हिंदी ट्रंसलेशन है उसमें सेक्युलरिज्म का अर्थ पंथ-निरपेक्ष लिखा हुआ है और सेक्युलरिज्म को पंथ-निरपेक्ष कहा जाना चाहिए। धर्म-निरपेक्ष पर प्रतिबंध लगाया जाना चाहिए ताकि राष्ट्र-धर्म और किसी मत या संप्रदाय का अंतर पूरी तरह साफ हो सके।

          I am not very happy the way hon. Judge, Shri Liberhan has submitted his Report. First, he has taken 17 long years. Crores of rupees have been spent. Ultimately, what has happened? He is soft towards the leaders of the BJP.  He did not mention any of the names of the BJP leaders in the Report. It has been said in the Report, at page 19, that “top leadership may not have approved the demolition, however their declamations remain only suspect.”  Unfortunately, he did not consider the records, which he should have done.  A designated court, on 8th September, 1997, framed charges against 48 persons, including Shiv Sena supremo, Shri Bal Thackeray, the then BJP President Shri L.K. Advani, Dr. M.M. Joshi, and Shri Kalyan Singh.  It was unfortunate that, at that point, ten Members of Parliament were involved in that incident.  It is most unfortunate for the democracy of our country.  He did not pin-point the leaders.  He has only said about Shri Kalyan Singh.  For that, one does not require to wait for 17 long years.  The leaders of the BJP have not been pin-pointed when specifically criminal charges have been framed under sections 147, 153 (a) (b), 295 (b), 505 and 105 of the Indian Penal Code. Mr. Chairman, you know very well the effect of framing of the charges.  This record has been totally ignored by Shri Liberhan.

          Closed circuit televisions and metal detectors were intentionally rendered inoperative and ineffective by the Government administration. No video recording of the event happened. Video recording, according to the rule of law, from the Government side has been stopped. The media was targeted and it was heavily harassed. According to the text of the Liberhan Commission Report, some media people had been arrested and they were housed in a very small place and some of those media people were molested. It was a very shameful act. The result of all this is the betrayal of the nation and Indian history. Such a person is now a sitting Member of this House which is the supreme institution of this country. ...*           Sir, the chief architect of the event was Shri L.K. Advani. He has initiated the Rath Yatra from Somnath to Ayodhya in 1990 which has created 3,000 riots all over the country. Thousands of people were killed. The Times of India, in its Editorial Page, has said that it was not a Rath Yatra, it was a ‘blood yatra’. Such a very shameful event had   * Expunged as ordered by the Chair.
