The principle of comity requires that the Courts of one State or jurisdiction will give effect to the laws and judicial decisions of another State or jurisdiction, not as a matter of obligation but out of deference and mutual respect. In Neon Laboratories Vs. Medical Technologies Limited, reported in (2016) 2 SCC 672, the Supreme has reiterated that every High Court must give due deference to the enunciation of law made by another High Court, even though it is free to charter a divergent direction. Judicial comity is recognized as an integral part of judicial discipline and judicial discipline is the corner stone of the judicial integrity.
