The present writ petition has been filed by the petitioners- defendants assailing the order dated 26.10.2016 passed by the learned Additional Senior Civil Judge, Rajsamand, whereby the application filed by the petitioners under Section 35 of the Rajasthan Stamp Act, 1998 (hereinafter referred to as 'the Act of 1998') has been rejected.

2. Shorn of unnecessary details, the relevant facts for adjudication of the present writ petition are that the respondents- plaintiffs instituted a civil suit seeking specific performance of an agreement to sell dated 07.02.2002 along with a prayer for permanent injunction.
