Regarding medical condition of applicant-accused, it was shown that the applicant is suffering from Coccydynia with Spondyloarthritis with low backache with PIVD (Prolapsed Intervertebral Disc), high BP, high bleeding, Vertigo and Nausea. There is a report of Institute of Medical Sciences, B.H.U., Varanasi, (annexure-3) to the effect that 'applicant is suffering from Chronic Supportive Otitis Media with Mastoiditis, we advised operation for the above disease. Meanwhile on 24.07.2019, patient started having low back pain for this we consulted the neurologist (Prof Vijay Nath Mishra) and on 25.07.2019, they shifted the applicant under their treatment.'

-The report dated 10.09.2022 of Swaroop Rani Nehru Hospital, Prayagraj mentions as under:

'Post auricular swelling with Left facial swelling and sub mandibular swelling and ear bleed from left side of EAC.

Patient was operated on 03.09.2022 for left CSOM and operative procedure is left myringoplasty and patient was discharged on 05.09.2022 in satisfactory condition. But patient is having complain of above symptoms seen on examination. Patient also complain vertigo and Nausea.

On the basis of examination and history, in my advice, patient should not be allowed for travelling because this operation (tympanoplasty) may be failed and should be on complete bed rest.'

-As per medical report dated 14.09.2022 of the Swaroop Rani Nehru Hospital, Prayagraj, applicant was advised to avoid travelling, head movement and to take some other precautions.

- As per medical report dated 10.07.2023 of the same hospital, 'applicant was operated on 3.9.2022 for left CSOM and operative procedure left Myringoplasty was done and discharged on 05.09.2022 in satisfactory condition but patient now having complain of tinnitus, vertigo, headache and memory lose'. It was also mentioned that patient not managed well within this condition.

-'The applicant was found suffering from 'Ear discharge, vertigo and headache with Chronic Suppurative Otitis Media with Mastoiditis and was advised for operation'.

-As per the report of department of Neurology, the applicant is suffering from 'Left CSOM with Mastoiditis L.B.P., Vertigo and Decreased vision Left Eye, Cervical Compression'.

-On 29.07.2021 the applicant was sent to Sir Sunderlal Hospital, B.H.U., Varanasi, and the Specialist has referred for 'Severe Tail Bone Pain and Degenerative changes + Cervical + Lumbar Vertebra Spine and was referred for Piles / Haemorrhoids'.
