3. This Court vide order dated 12.09.2024 directed the parties to appear before the Illaqa/Duty Magistrate for recording their statements, as contended before the Court, and the Illaqa/Duty Magistrate was also directed to send its report.
4. In pursuance to the same, learned Judicial Magistrate Ist Class, Jalandhar has sent the report dated 18.11.2024 to this Court. With the report, he has also annexed the original statement of respondent No.2/complainant namely, Khushkaran Pal; joint statement of petitioners, namely, Harshdeep Singh @ Arsh and Dhruav Kainth recorded on 04.11.2024 and statement of ASI Sanjeev Kumar recorded on 04.11.2024. On the basis of the statements, learned Judicial Magistrate Ist Class, Jalandhar has concluded in the report that the compromise effected between the parties is genuine and it is not the result of any fraud or misrepresentation and is the result of free will of both the parties. It has been mentioned therein that petitioners were not declared as proclaimed offenders in this case.
