Thus, the aforesaid judgments of this Court and judgments of the Apex Court leaves no doubt that the provisions of Section 49 of the Act,1993 providing for removal of the Adhyaksha by no confidence motion have to be given effect to irrespective of the fact that there is only one candidate in the said reserved category and that even after such removal the said candidate would have to re-elected.
15. No confidence motion is a constitutional/ statutory right vested with the members of the Panchayath for the effective, stable and transparent governance of the Panchayat Bodies.
