4. The respondents filed counter affidavit opposing the OA. It is stated that the notification issued by RRB No. 03/2015 issued on 26.12.2015 was for recruitment to NTPC (Graduate) posts. This recruitment included different categories of posts including Traffic Apprentice (TA), Commercial Apprentice (CA), Enquiry-Cum-Reservation Clerk (ECRC), Goods Guard, Senior Clerk-cum-Typist, Junior Accounts Assistant-cum-Typist (JAA) etc. and all the posts had different pay scales and GP. Only the post of CA and TA had the GP of Rs. 4200/- at the time of issuance of CEN No. 03/2015. It is stated that the selection was made according to the detailed guidelines prescribed for the candidates. As a policy, for the posts of TA and CA which have a higher GP of Rs. 4200/- no standby list is prepared and for the rest of the posts having GP of Rs. 2800/- and Rs. 2000/- a standby list is prepared. This was in view of the fact that any selection from the reserve panel of a lower merit candidate to a post with higher GP shall result in a candidate of lower merit getting finally selected in comparison to the other candidates ranking higher and being selected for other posts with lower GP. On the recommendations of the 07th CPC, the Ministry of Railways has decided to upgrade the GP of the posts of ASMs to Rs. 4200/- from Rs. 2800/- and accordingly the policy of not keeping the standby list for post having GP of Rs. 4200/- i.e. CA and TA was also extended to the post of ASM. It is stated that the notification dated 27.10.2017 was to clarify the position regarding non-maintenance of reserve/standby list for the post of ASM. It is also stated by the respondents that the RRB has the authority to undertake changes/modifications in general instructions in case of policy change. It is also stated that non maintenance of reserve/standby list is not akin to non-filling of the advertised posts.

7. The RRB issued CEN No. 03/2015 on 26.12.2015 for filling up vacancies of NTPC graduate posts. Detailed guidelines and instructions for the said examination were indicated in the CEN. This recruitment in NTPC category was for various posts including Traffic Apprentice (TA), Commercial Apprentice (CA) (GP of Rs. 4200/-) Enquiry- Cum-Reservation Clerk (ECRC), Goods Guard, Senior Clerk- cum-Typist, Junior Accounts Assistant-cum-Typist (JAA) (Rs. 2800/-) and Traffic Assistant (GP- Rs. 2000/-) etc. The candidates are required to give their preference for different services. The selection process is also different for different posts. For the post of ASMs,, in addition to the written test, there is a psycho test and a typing test which is to be undertaken by the candidates. The applicants were successful in the written examination and were thereby called for psycho and typing test. Subsequently, for undertaking document verification, the candidates equal to number of vacancies plus 50% extra were called for different categories. The applicants were also called for document verification in addition to the main panel of successful candidates.
