4. Annexure-A5 notification specifically prescribed experience in freezing and canning plant. Annexure R3(e) certificate is with respect to the specific work experience the third respondent had and Annexure A12 with respect to the designation of the third respondent. We do not find any anomaly in the certificates to set aside the appointment granted to the third respondent.
5. One another contention raised is of the seventh respondent who is the consultant of the first respondent having counter signed and attested Annexure R3(e). The learned Central Government Standing Counsel appearing for the first respondent submits that in fact the first respondent sources people from the Societies for the purpose of casual labour and these Societies are registered under the Apex body 'the Matsyafed'. In fact, the payments made to the contract workers of the society was by the first respondent and hence the 7th respondent had counter signed the certificate, is the submission. We do not find any reason to interfere with the selection carried out and in such circumstance though we do not agree with the findings of the Tribunal that the petitioner was not qualified to apply, we do not think that the Original Application can be entertained. Hence, the Original Petition is dismissed and so is the Original Application. No order as to costs.
