Though some of the offences alleged to have been committed by the accused fall in the category of offences in respect of which the bar of 13 wp459,460,550.14 & apl318.14 Section 195 of the Code of Criminal Procedure may be attracted, in my view, the learned Chief Judicial Magistrate will have to apply his mind on this aspect also and record his conclusions. I find that the learned Chief Judicial Magistrate has not applied his mind at all to this aspect.
