It is averred that the Defendant is operating under the name 'Nextherm Heat and Mold Tech' by appropriating the mark of the Plaintiffs in entirety as also using the infringing logo mark for conducting his business, which is identical to that of the Plaintiffs i.e. manufacturing, trading and wholesaling in Neutral Citation Number: 2022/DHC/005205 industrial heaters, temperature sensors, electric heating elements and engineering services etc. Defendant is openly and extensively advertising through various third party websites like Indiamart, Justdial.
