4. The reasoning adopted by the third respondent, refusing to register the Sale Deeds, appears to be misplaced. G.O.Ms.No.78 dated 04.05.2017, does not relate to the powers of the Registering Authority to register an unapproved plot. On the other hand, G.O.Ms.No.78, only provides for the cut off date for considering the regularization of https://www.mhc.tn.gov.in/judis unapproved plots and does not empower the Registering Authority to refuse registration of an unapproved plot. It is also not in dispute that there is no other Government Order or Circular of the Inspector General of Registration, which prohibits the registration of an unapproved plot. Above all, the plot 32 in Survey No.320/3, which is now said to be sold through petitioner's Sale Deed dated 25.01.2023, has been regularized by the Tamil Nadu Real Estate Regulatory Authority through their order in TN/5/Regularisation-Layout/10150/2022 dated 19.12.2022. Thus, placing reliance on G.O.Ms.No.78 dated 04.05.2017 and refusing registration, in the absence of any regulations empowering the Registering Authority to refuse such registrations, is illegal.
