38 The principle which has been enunciated in Virpal Singh Chauhan (supra) has come to be known as the ‘catch-up’ rule. In Ajit Singh Januja v State of Punjab28 (“Ajit Singh I”), a three judge Bench of this Court adopted the catch-up rule propounded in Virpal Singh Chauhan (supra). This Court held that a balance has to be maintained so as to avoid reverse discrimination and a rule or circular which gives seniority to a candidate belonging to the reserved category promoted on the basis of the roster point would violate Articles 14 and 16 of the Constitution.
