Petitioner seeks grant of interim regular bail under Section 439 Cr.P.C in case bearing FIR No.58 dated 16.04.2019, registered under Sections 18/61 of the NDPS Act at Police Station Guru Harsahai, District Ferozepur.

Petitioner seeks interim bail on the ground that marriage of his daughter is fixed for 02.02.2020.

Notice of motion was issued on 22.01.2020. Learned State counsel on instructions from ASI Atma Singh submitted that the police has verified the factum of marriage of daughter of the petitioner which is going to be 1 of 2 solemnized on 02.02.2020. Shagun ceremony of the daughter of the petitioner is fixed for 01.02.2020. Petitioner is also involved in two other cases in which he is on bail.

Looking to the nature of the prayer made by the petitioner which is authenticated by the marriage card and inquiry conducted by the police, I deem it appropriate to enlarge the petitioner on interim regular bail for a week commencing from 31.01.2020.

In view of above, petition is allowed. Petitioner is ordered to be released on interim regular bail, subject to his furnishing adequate bail bonds/surety bonds to the satisfaction of the trial Court.

Petitioner shall surrender before the trial Court on 06.02.2020 during course of the day.
