1. The issue involved in the present writ petition is that whether the petitioner company, which stores corrugated boxes and other packing material for storage of its fruit juices would be required to take a municipal license in terms of Section 417 of the Delhi Municipal Corporation Act, 1957 (hereinafter the 'DMC Act').

2. Mr. Rajiv Tyagi, counsel appearing on behalf of the petitioner submits that since the petitioner company has the requisite licenses under the provisions of The Food Safety and Standards Act, 2006 (FSSAI Act), no municipal license would be required.

3. Ms. Beenashaw N. Soni, counsel appearing on behalf of the respondent no.1/MCD submits that since the activity carried out by the petitioner falls within the ambit of activities mentioned in Schedule 11 read with Section 417 of the DMC Act, the petitioner would be required to take the municipal license.

4. After some hearing, it has been put to Ms. Beenashaw N. Soni to check whether any circulars / office orders had been issued by MCD in relation to 'ease of doing business', which would dispense with the requirement of the petitioner to obtain such license. 4.1. Ms. Beenashaw N. Soni seeks some time to verify the said position.

5. Re-notify on 29th April, 2026.
