The plaintiff has filed the present revision under Article 227 of the Constitution of India for challenging the order dated 6.12.2012 passed by Civil Judge (Junior Division), Panipat whereby application filed by him for additional evidence stands declined.
The petitioner intended to bring on record copy of Parat Sarkar of mutation No. 3233, certified copy of plaint dated 10.9.2007 and order dated 29.11.2007 passed in civil suit No. 302/7 besides certified copy of Khasra Girdawari for the period from Kharif 2006 upto Kharif 2010. The explanation given by him in not tendering the aforementioned documents at the appropriate stage was inadvertence. Apparently, the aforementioned documents were in the knowledge of the petitioner. In such a situation, once, his evidence stood closed, the petitioner could not have been granted permission to lead additional evidence.
