Learned counsel for the appellant further submitted that according to Rule - 7 (3) of the Railway Passenger (Cancellation of Ticket and refund of fare) Rules, 2015 with effect from 12.11.2015 - "no refund of fare shall be granted on RAC ticket or wait listed ticket after thirty minutes before the scheduled departure of the train." Since the complainant approached after half an hour of before schedule departure of the concerned train, he is not entitled to refund of the fare of the ticket. Learned District Forum failed to appreciate such fact and law for which the appellants are compelled to file the appeal. Further, it is submitted by the learned counsel for the appellants that there is Railway Claims Tribunal Act, 1967 to consider the plea raised by the complainant in this case and learned District Forum has no jurisdiction to entertain such complaint. So, the complaint petition is not maintainable. In toto the impugned order is illegal, improper and liable to be set aside.
