4. _ The factual matrix of the matter is that the National Defence Academy, Khadakwasla, Pune his a Teaching--cum--Training Institute for Military officers and is affiliated to the JNU, New Delhi on the basis of' the Jawaharlal Nehru 'University' (NDA) Ordnance, 1973. The NDA recruits academics through the UPSC for .
different _ subjects such.y as Physics, "Chemistry,
Computer Science, Mathematics, -Geography, History,
Economics, Political Science, English, Hindi, Foreign
Languages and.IBasic IEngineering" and. awards degrees

from the JNU -to the graduates of its training

5. _ On 16.05.2017, _ the Principal issued ' a

departments by grouping existing departments into a

The applicants are Professors in various disciplines at the academy and object to this reorganization because they fear that as Professors, theywould have to work under and take instructions and report to their juniors name.ly, their Associate Professors on day"-to---~day work and duty and would not be allowed to act as HoD, which they claimed is contrary to their terms and conditions of selection E F as Professor against the advertised post. He/she will be the sole custodian of the departmental infrastructures. He/she will exercise disciplinary control over the staff in the department and. initiate .Annual Performance Appraisal Reports of the staff in the department. The present learned Counsel for the applicant issued a legal notice dated 07--07~20l7 (Annexure A-9) to respondents on behalf of unspecified teaching faculty of NDA claiming that they have been selected by the UPSC and their service conditions cannot be - 1 changed without the approval of Ministry of Defence. They have also referred to the advertisement of UPSC and alleged that the present SOP 'deviates from the service conditions specified in the advertisement. As per the service conditions, they were to be appointed
-1 as Head - of Department and the Commandant and J Principal of NDA has no such power to change their service conditions including restructuring of academic departments. They have conveyed their fears that as a result of this SOP, the senior Professor and Head of Department may be required to work under eul Associate Professor in ran; newly grouped faculty even though the latter is junior to the former. When the matter came up for admission on 19.12.2017, it was reserved for orders after hearing learned Advocate inn: applicant. 11; "was 'however thereafter posted "for being spoken to" on 02.01.2018 and was heard on 03.01.2018 when the learned counsel for the applicants was asked to ,explain' how the grievance fell vmifim11"the definition of time "service matters' under the Administrative Tribunals Act, 1985. The learned counsel was also asked to explain as to how SOP deviated from the terms and conditions specified in time advertisement. Learned counsel sought time for examining the issue and was heard on 28.02.2018. On the aspect of_ service matters,' he F .

When we compare the SOP and the description in the advertisement, it is patently clear that there is In: variation jJ1'th€ service cbnditions specified in the advertisement and as specified in the SOP. This situation. perhaps did. arise when the initial circular was issued 'on l6.05.20l7 (Annexure--A~3) created groups of department and rename them as department _of languages _etc. Evidently, the respondents corrected tflmmne descriptions 311 response to the complaints by professors in May, 2017 and drew up an SOP which incorporated their views and without affecting, their service conditions while also achieving administrative goals that had been constrained by exigencies of shortage of clerical and .- ,_ |

MTS staff. We note that the advertisement refers to responsibility for both faculty, clerical and nenial hands. The SOP continues arrangements in respect of faculty and only takes away the direct and exclusive control of HoD over the MTS (Peon) while the clerk, if at all previously available, is now attached to < the -group of depar_tment.s called faculty. As regards the work of MTS in the department, it is left to the HoD ix) extract necessary official work;anui complain if the person is unsuitable which he wasalso doing previously. In conclusion, it is clea-r that service conditions of the professors have not at all been implicated in this SOP as issued on 29.06.2017 and the applicants can have no grievance -in this matter but should rather co-~operate with the administration for ensuring that. the limited supporting .staff available are fully utilised in the most suitable and efficient mannerpossible. In the result, there are no merits in the- application. The application is accordingly dismissed in limine. No costs.
