(a) F.I.R. 155 / 04.08.2012 registered in Keelavalavu Police Station:-

Under IPC 447, 201, 379, 4(1), 4(2)(A), 4(3) and 21(b)(5) of MM(D&R)Act, 1957, 3(1) of TNPPDL Act, Section 3 and 4 of the Explosives Substances Act, 1908.

Regarding the above I submit that the petitioner is having quarrying lease in respect of S.F.No.95/2A, 95/2b, 95/8, 97/1, 97/2, total extent of 1-63- 0 hectares and the lease was granted in the year 2005 by G.O.Ms.No.59 dated 21.07.2005 for a period of 20 years. Whereas the above mentioned case is registered alleging that there are pits available in the adjacent Survey S.F.No.71 and 70/3 and the petitioner is responsible for the alleged pits. At this juncture it is to be noted that the petitioner is quarrying in the leasehold area and never quarried in any non-leased area and the officers of Mining Department and Revenue Department are inspecting periodically the lease hold quarry of the petitioner and never detected any violation whatsoever. Just because there are pits adjacent to the lease area of the petitioner the third respondent cannot presume or assume that the petitioner is responsible for the alleged pits.

Under IPC 447, 201, 379, 4(1), 4(2)(A), 4(3) and 21(b)(5) of MM (D&R) Act, 1957, 3(1) of TNPPDL Act, Section 3 and 4 of the Explosives Substances Act, 1908.

Quarrying lease has been granted by G.O.3(D) No.18 dated 08.04.1994 for a period of 10 years from 08.04.1994 to 07.04.2004 in favour of Coramandal Company, Chennai in respect of their patta lands comprised in SF.Nos.63/5, 6, 8, 9, 10, 11, 12, 13, 14B and 64/1, 2, 3, 4, 5 totally measuring 2.00.0 Hects., situated in Idayapatti Village, Madurai North Taluk, Madurai. The said company operated the said quarry for the full period of the lease i.e., till 2004 and thereafter continued quarry operations with the interim orders granted by the Hon'ble High Court. After removing all the marketable material by the said company the entire waste materials and debris are lying at the subject quarry. The petitioner purchased the said lands in March 2010. After purchase of the said lands so far petitioner has neither applied for quarrying lease nor quarried any material in the subject area. Facts being the above the above mentioned complaint is lodged as if the quarrying operations are carried and materials are stored in the subject quarry without quarrying lease. The said allegation is made basing on the said waste materials generated during the quarrying operations done by the vendor of the petitioner and without even verifying the factual aspects and ground realities.
