She further deposed that she lived in the house alongwith her mother, Mama namely Nitin Raghav, Mami Ruchi Raghav, their children, Nana and Nani. On 12.09.2015 at the time of incident, she alongwith her mother was present in the house. The photocopy machine was being run in the front portion of the house. It was correct that there was one counter and it had a passage to enter on the other side, next to the photocopy machine. It was correct that there was one dry clean shop and one residential house adjacent to both side of her shop. It was correct that there a busy road in front of her shop. It was correct that she used to visit Yashodha Dairy frequently to bring milk prior and after the incident and the Yasodha Dairy was approximately 400 meters from her residence in the same row of her house in the right direction in case she come out from her house. It was correct that the said dairy was in DDA Flats, Kalkaji. She could not say dairy was in block 10 and house no.290. It was correct that she had seen the accused several times there FIR No. 791/2015 State Vs. Sarabjeet Singh 5 of 24 after the incident and not prior to the incident while she used to bring the milk. It was wrong to suggest that she had seen the accused several times at Yasodha Dairy while she used to bring milk prior to incident. She had visited several times at Verma Chemist and dispensary in L1 Market LIG Flats. She had seen the accused 23 times at Verma Chemist and dispensary after the incident and not prior to the incident. It was wrong to suggest that she had seen the accused several times at Verma Chemist and dispensary in L1 Market LIG Flats prior to incident also. She did not have personal knowledge if the accused was residing at the floor of the house adjacent to Yasodha Dairy. She did not know if the accused was running his business of Tours and Travel from L1 Market. It was wrong to suggest that accused had come at the shop while she was present at the shop for about 2025 times prior to the incident to get photocopy of the documents. She did not recognize the identity of the said card whether it was of the accused or some other person. It was correct that there was a fax machine also at the shop prior to the incident. It was correct that the other people from the neighbourhood also used to get their fax copies from the fax shop. She could not say whether L.M. Tours and Travel owned by father of the accused also used to get their fax documents procured from her shop. It was wrong to suggest that she was intentionally telling lie in the court that L M Tours and Travel used to get their fax documents through her shop. It was wrong to suggest that she knew accused prior to the incident as the accused was residing in her neighbourhood approximately 400 meters away from her house near Yashodha Dairy. Her mother was in kitchen at the time of alleged incident. She told her mother that FIR No. 791/2015 State Vs. Sarabjeet Singh 6 of 24 one sardar came at the shop and forcefully provided his number and asked to call her anytime for friendship when the said sardarji visited the shop first time. She did not remember what her mother said to her after she narrated the incident to her. Neither her nor her mother had made any call at 100 number when the accused first time visited her shop and allegedly was trying to give his number etc. Her mausi to whom she made a call was staying in Palwal. She again stated in Uttam Nagar and again said that she did not remember. She used to talk to her mausi frequently. She did not remember the exact mobile phone number of her mausi. Her maternal uncle Nitin Raghav reached the house at 8:00 pm, on the date of incident. Neither her nor her mummy made any call at 100 number or any complaint to the police officials between 1:30 pm to 8:00 pm. However, She did not remember at what time the complaint was made to the police officials. She could not tell whether her maternal uncle Nitin Raghav talked to the accused person at about 2:30 pm on the date of incident. It was wrong to suggest that her maternal uncle Sh. Nitin Raghav talked to the accused person at about 2:30 pm. It was correct that she had stated in her statement u/s 164 CrPC Ex.PW1/B that Lucky (accused) came to house, she was not having the change of Rs.10.00/ then Lucky said no problem (koi nahi), he would take later on. He also said that she was cute and asked whether she was on watsapp or not. She was confronted in this regard with her complaint Ex.PW1/A and also was confronted with her statement that "when I was going inside to make the payment of the balance money then he hold me from the backside and started touching me on different parts of my body". She was also confronted with Ex.PW1/A that "I FIR No. 791/2015 State Vs. Sarabjeet Singh 7 of 24 also stated before the Ld. MM u/s 164 CrPC statement that he also holded me in between my legs" and "I also stated before the Ld. MM in my statement u/s 164 CrPC that I told him that my mother is inside". She did not know whether the accused was residing at 10/293, DDA Flats, Kalkaji, New Delhi. She could not say that the place where she was running the shop in her house was residential area and commercial activities were not allowed in that area. She could not say that the shop, they were running in the said house was illegal and was not regularized by the competent authority. She could not tell how many times she visited the police station or she was inquired by the police officials. It was wrong to suggest that on the date of incident the accused came to her shop for photocopy and he was not having the change money for which she became angry and started scolding him for the same. It was further wrong to suggest that when she scolded him he answered back and for which she started abusing him in filthy language and there was an oral quarrel between them. It was further wrong to suggest that while the accused was leaving the shop he warned her and challenged her that he would make a complaint to the MCD and other concerned authorities and get the shop closed. It was further wrong to suggest that in fear of above challenge of the accused after having loan deliberations with the family members she made the present false complaint against the accused person to deter him from making any such complaint against her shop. It was further wrong to suggest that she had filed the present complaint against the accused after having long deliberations with her mama, mami and mother.
