4. It is the case on behalf of the petitioner that the petitioner has been in possession of the land in question measuring approximately 310 Sq. Yards since the year 1940. It is submitted that a Kali Temple was constructed on the land in the year 1940 and the premises has come to be known as Minto Road Kali Bari. It is submitted that daily pooja, both in the morning and in the evening, is being carried out in the mandir. It is further submitted that since 1941, a landmark Durga Puja known as Minto Road Durga Puja is celebrated every year at the Kali Bari with great fervour.
