1) Delay condoned, abatement stands set aside. Application for substitution to bring on record the legal representatives of deceased petitioner (Nainmal Sagarmal Kankaria) is allowed.

2) Permission to file special leave petitions is granted. 

    3)     Delay in refiling is condoned.

    4)     We see no reason and ground to interfere with the

impugned judgment passed by the High Court. At this stage, learned counsel for the petitioners persuaded us that due to decree of ejectment execution is pending, however, some time to vacate the premises may be allowed.
