8. Further, according to him, his annual performance for the period from 2006-2013 was 8.54. In this regard, the learned counsel for the applicant has referred to the copies of the ACRs during the period from 2006 to 2012. The gradings given to him were either also Very Good or Out Standing. He has also submitted that the respondents decision of terminating his contract on the basis of the 10 minutes review, disregarding his record having rating Average of 8.54 on a 10 point scale over a period of 9 years smells of vindictiveness. Further, he has stated that considering his outstanding performance, the respondents themselves have promoted him from the post of Project Engineer to Senior Project Engineer on contract basis vide office order dated 03.08.2010. Further according to him, before the impugned order terminating his contract was issued he has never been given any show cause notice or any memorandum showing his shortcomings.
