The petitioner is a defaulter in repayment of loan amounts due to the 2nd respondent society. The 2nd respondent society initiated coercive recovery proceedings, in which the property belonging to the petitioner was purchased by the 2nd respondent society itself in auction. The petitioner now submits that the property in question comprised of the dwelling house of the petitioner and his family and the petitioner is prepared to pay the entire amounts due, on payment of which the petitioner society may be directed to re-convey the property to the petitioner. Seeking this relief, the petitioner has filed Ext.P2 petition before the 2nd respondent society. The petitioner seeks a direction to the 2nd respondent to consider and pass orders on Ext.P2.
2. I have heard the standing counsel appearing for the 2nd respondent also.
In the facts and circumstances of the case, I dispose of this writ petition with a direction to the 2nd respondent to consider W.P(C) No. 32958 of 2009 -2- and pass orders on Ext.P2, as expeditiously as possible, at any rate, within two weeks from the date of receipt of a copy of this judgment, after affording an opportunity of being heard to the petitioner.
