The accused Azam is facing trial in the present case, on allegations that he along with his associate Y (CCL), committed robbery of two mobile phones i.e. one make POCO F1 grey colour and another make JIO keypad and Rs.35,000/- from the possession of the complainant Naveen Kumar, and while committing the said robbery, the accused used a deadly weapon i.e. a knife. Subsequently, the said stolen mobile phone make POCO F1 of grey colour, belonging to the complainant, was recovered from the possession of the accused,
16. PW 11 Sh. Sajid Khan deposed that on 13.11.2018, he had purchased one mobile phone make POCO F1, online, for a sum of Rs. 21,000/- approximately, vide bill Ex. PW4/C. He used that said mobile phone for about 15 days, and thereafter sold the same to his room partner namely Naveen Kumar s/o Sh. Anand Singh r/o Sonepat, Haryana, but no document was executed at that time, regarding handing over the mobile phone to Naveen Kumar. PW 11 SC No. 622/2019 State Vs. Azam correctly identified the said mobile phone in the photograph of the phone Ex.PW4/D-5, while the of mobile phone, make POCO F1 is Ex. P-2.

PW 8 correctly identified the photographs of the mobile phone make POCO as Ex D-4 and D-5, being the photographs of the mobile phone POCO, which was recovered from the possession of accused Azam, as well as the photographs of mobile phone make JIO as Ex D-1, D-2 and D-3 being the photographs of the mobile phone make JIO, which was recovered from the possession of CCL 'Y'. He SC No. 622/2019 State Vs. Azam correctly identified the four photographs as Ex.X1 (colly), being the photographs of the offending vehicle, i.e. motorcycle bearing registration No. DL11 SY 0517.

PW 4 handed over the bill / invoice of his robbed mobile phone make POCO F1, to the IO on 01.05.2019, which was seized by him vide seizure memo Ex.PW4/B, and he proved the said invoice as Ex.PW4/C. PW 4 further deposed that the other mobile phone, was of JIO company. At the time of recording of his testimony in the court, PW 4 pointed out towards accused Azam, and identified him as the driver of the said Pulsar motorcycle, and as the person, who had pointed out a knife at him. PW 4 further deposed that on 09.05.2019, he went to the PS to inquire about his case, and identified the accused Azam before the IO, in the Police Station. His both mobile phones were recovered during the investigation, and were released to him, on Superdaari by the Court, and he brought both his mobile phones in the court as Exs.P-1 (JIO) and P-2 (POCO), along with photographs Exs. PW4/D-1 to PW4/D-5.
