Iii)     Ld.   Trial   Court   ignored   the   fact   that   respondent   no.   1 nowhere mentioned about the liability of the appellant towards respondent no. 1 in the trial court.  The perusal of legal notice dated 11.07.2005 issued on behalf of respondent no. 1 does not disclose any amount and no statement of account was filed by the respondent no. 1 till 27.10.2017.   Respondent no. 1 filed uncertified   unsigned   statement   of   account   which   is   neither verified nor signed or acknowledged.
