27. In support of aforesaid submission, reliance was made on the decision of Hon'ble High Court of Delhi as available in the matter of L.K. Advani vs. Central Bureau of Investigation reported in 1997 SCC Online Del 382.
28. It is pointed out that no adverse interference can be drawn against the petitioner for the payment of Rs. 68.85 lacs made by Pawan Kumar to "Triveni" as to facilitate its participation in tender process while "Triveni" was only being used as a tool to enter into the tender process and subsequently, the entire contract work for the said tender came to the sub-contracted to "Matriswa" for the reason that this allegation is without any substantive material or evidence. Even as per the ED's prosecution complaints, no statement Patna High Court CR. MISC. No.32054 of 2025(13) dt.25-09-2025 from any representative of "Triveni" has been recorded in support of the said allegation, suggesting that the ED is entirely speculative qua said allegation.
