The highly competent counsel Mr.V.Dinesh Raja appearing for the petitioner submits that the petitioner is the absolute owner of the building at Plot No.32, Old Door No.9, New Door No.28, Annamalai Colony, Virugambakkam, Chennai  600 092. He had obtained building plan approval from the 5th respondent on 14.06.2013. After obtaining the said approval, he has constructed Stilt+3 floors with 6 dwelling units of residential building. After completion of the said building, he had approached the respondents 1 to 4 for effecting electricity service connection. The respondents insisted the petitioner to produce No Objection Certificate from the 5th respondent. The petitioner has constructed the said building without any deviation or violation. Further, now, the occupants are waiting for new electricity service connection, which is a very basic amenity.

13. The highly competent counsel Mr.P.Tamilavel, appearing for the 5th respondent submits that the petitioner had obtained building plan from the 5th respondent dated 31.12.2012. The petitioner has constructed his building with deviation and violation. Therefore, the 5th respondent has to inspect the building to determine the deviation and violation and only then the Completion Certificate can be issued, which is required by law. Therefore, the petitioner cannot get electricity service connection from the respondents 1 to 4 without obtaining No Objection Certificate from the 5th respondent.

On Considering the facts and circumstances of the case and arguments advanced by the learned counsel on either side, the views as mentioned above, (i) to (iii) this Court is inclined to allow the above writ petition and directs the respondents 1 to 4 to receive the petitioner's application without insisting upon the Completion Certificate/No Objection Certificate from the 5th respondent and to provide electricity service connection to the petitoiner's residential building at Plot No.32, Old Door No.9, New Door No.28, Annamalai Colony, Virugambakkam, Chennai  600 092, within a period of fifteen days from the date of receipt of application given by the petitioner. However, the 5th respondent is at liberty to initiate legal action in the event of violation or deviation over the building construction.
