In Lestrange v. F. Graucob Ltd. - [1934] All .E.R. (REP) 16, it was held that the contract having been signed by the buyer, the implied warranty was excluded by the express condition in the contract, notwithstanding that the buyer did not know that the contract contained such a condition. In this case it was also held that where a term or condition is contained in a railway ticket or other unsigned document it is necessary, to bind the recipient of the document, to prove that he was aware or ought to have been aware, of the term or condition, but when a document containing contractual terms is signed, in the absence of fraud or misrepresentation, the party signing it is bound, and it is wholly immaterial whether or not he has read the document.
