However, when the petitioner approached the executing court for stay in connection with the petitioner's application filed in the execution case levied in connection with the ejectment suit, the executing court refused to grant stay, against which the present revision has been preferred.

The learned advocate appearing on behalf of the opposite parties seriously opposes such prayer for stay and primarily submits that no occupational charges have been imposed while granting such stay.

Although there is some doubt as to whether occupational charges could be granted while granting stay in respect of a co-sharer, the petitioner is justified in arguing that the said question ought to have been prima facie decided by the executing court.

Accordingly, the revisional application bearing C.O. 2103 of 2019 along with the application being CAN 9293 of 2019 are disposed of by setting aside the impugned order and granting stay of Ejectment Execution Case No. 85 of 2017 pending before the Civil Judge (Junior Division), Second Court at Alipore, District - South 24-Paraganas, till November 30, 2019 or until further orders being passed by the executing court.
