Mr. Deka, learned counsel for the petitioner has submitted that the petitioner came to be appointed as Computer Instructor by the Principal, Dhing College by an appointment order dated 31.07.2008 issued under the seal and signature of Dhing College [Annexure-9 to the additional affidavit]. Thereafter, the petitioner was assigned additional charge of teaching Post Graduate Diploma in Computer Application [PGDCA] Course in Dhing College and for the said additional charge, he was paid additional Rs. 500/- per month w.e.f. 01.08.2008 [Annexure-10 to the additional affidavit]. In order to buttress his submission to the effect that Dhing College, a provinialized college, used to run a PGDCA Course, he has referred to an advertisement issued by the Institute of Distance and Open Learning [IDOL], Gauhati University and the application forms submitted by the various students intended to undergo the said PGDCA Course, money receipts, daily class routine, deposit forms evidencing deposit of requisite exam fees through bank challan of State Bank of India in favour of Gauhati University, etc. 3.1. It is submitted by Mr. Deka, that the petitioner had left the post of Computer Instructor/Faculty in the year 2017. During his tenure as Computer Instructor/Faculty, Dhing College used to run PGDCA Course of 1 [one]-year duration and any certificate issued in respect of a bona fide student during that period cannot be termed as forged. Mr. Deka has further submitted that the entire confusion has been arisen due to a statement made by the present Principal of Dhing College, Sri Biman Hazarika to the effect that the College did not run any PGDCA Course. The present Principal has joined the post only in the year 2019 and the PGDCA Course ran till 2018 and the Principal of Dhing College, at that point of time, was one Dr. Sarat Kumar Dutta. The present Principal has made the statement without verifying the actual facts.
