It would be not only be travesty, but mockery of justice if construction put up wholly against the contractual obligations is to be allowed, rebated or discounted. That has not been done in the judgment. It cannot be done in any order. It is, therefore, that in paragraph 51 of the judgment the case of the applicants for the 15% of the total construction as commercial premises under the Development Control Rules (DC Rules) of the MMC was separately considered.
