5.2. It is the specific contention of the defendant that he never handed over the possession to the plaintiff at any point of time. The contention of the plaintiff that he is always ready and willing to get the sale deed executed, is also denied and the agreement in question was given up long ago when the buildings are put up by the defendant. The contention that the plaintiff has prepared two draft documents and sent the same to the defendant. This defendant had agreed for the same but the plaintiff has not prepared the draft agreements, signed by him. Hence it is the contention of the defendant that by sending two draft sale agreements, the plaintiff cannot claim right from the year 1984. The allegation that the defendant tried to tresspass into the suit property is also denied. Further it is also denied by the defendant that the suit is hit by Order 2 Rule 2 of Civil Procedure Code.
