Heard on I.A.No.1520/2023, which is an application for temporary bail of appellant No.2-Popendra Kashyap for one month to attend the marriage ceremony of his sister - Rekha which is fixed on 24.02.2023. Application is supported by affidavit and annexed with invitation card.
Learned counsel for the appellant submit that as per Hindu custom at the time of marriage of sister, presence of brother is necessary for marriage custom and therefore, prayer for temporary bail is allowed for a period of one month.
Learned Government opposed the prayer for grant of temporary suspension of the jail sentence.
Considering the nature of the offence and role atributable to the appellant No.2 in the offence, we are not inclined to allow the temporary bail for appellant No.2 on the ground of marriage of his sister.
Accordingly, I.A. No.1520/2023 is dismissed.
