Respondents 3 and 4 filed their counter statement contending that respondents 7 and 8, local bodies are situated on the upstream of Mettupalayam Town having total population of about 11,600 and 3,900 respectively and generates solid wastes of around 2.5T/day and 1T/day respectively. The solid wastes are collected and dumped without any treatment in open land. As per Rule 15(y) of the Solid Waste Management Rules, 2016, every local body shall make an application for grant of authorization for setting up solid waste processing, treatment or disposal facility, if the volume of waste is exceeding five metric tones per day from the Pollution Control Board but they have not filed any application for authorization. They discharged the sullage and untreated sewage into the river through odai without treatment.
10.7th respondent Mettupalayam Municipality is located along the highways leading to Udagamandalam District population of which is about 70,000 and generates solid waste about 35 to 40/T per day which is being collected and converted into organic manure through composting and sold out to farmers. Solid waste processing site is located in survey no 77 part and 78 part of Sikkadasampalayam village, Mettuplayam.
Authorization was issued to the solid waste processing facility vide proceeding no. MSW.007/DEE/TNPCB/CBN/2015 dated 21.07.2015 valid up to 20.07.2016. They filed an application for renewal of authorization on 29.08.2016. They were asked to furnish some additional details vide their letter no. F. CBN.001(MSW)/DEE/TNPCB 2017 dated 20.01.2017 and the issuance of authorization is under process. They installed biomethanation plant at Sy. No. 77/2 and 78/1 of Sikkadasampalayam village, Mettupalayam to convert the segregated organic solid waste generated from markets, hotels, restaurants etc into biogas and organic manure. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 was issued to the plant with validity upto 31.03.2017. No industrial wastes are disposed into the River Bhavani.
2.4 Mettupalayam Municipality Mettupalayam Municipality is located along the highway leading to Udhagamandalam District with a population of 70,000.As informed by the Municipality officials, around 35 to 40 tons of solid waste is generated per day. Solid waste generated is collected, segregated and treated through composting and the compost thus generated is sold to farmers. The solid waste processing facility located at Survey Nos. 77 part and 78 part of Sikkadasampalayam Village, Mettupalayam have a capacity of 35 Tons per day. The Mettupalayam Municipality has obtained Authorization under the Solid Waste Management Rules, 2016 vide Proc. No. DEE/TNPCB/CBN/MSW-001/2018 dated 30.01.2018 with validity period of five years (i.e. 29.01.2023).
From the progress report, it is observed that for Package I and II (Construction of UGSS, Manholes etc.) 52.5 % of the work has been completed and Package III which is the construction of STP, 56 % of the work has been completed. The same was verified during inspection and photographs are attached as Annexure 6.
2.5. Sirumugai Town Panchayat Sirumugai Town Panchayat is located in the downstream of the Mettupalayam Town and Bhavani River. At present the population of the Panchayat is about 25000.As informed, the Town Panchayat generates about 2.3 TPD of solid waste. Solid waste generated from the entire town is collected and dumped without any treatment in open land. The Town Panchayat is under the process of finding suitable land to set up solid waste processing facility. The Executive officer, Sirumugai Town Panchayat has been addressed by DEE, TNPCB, Coimbatore North to follow the provisions of "the Solid Waste Management Rules 2016" for handling of solid wastes generated. However, the Town Panchayat is under the process of setting up waste processing, treatment and disposal facility with capacity of less than 5 T/day which is exempted from obtaining consent and authorization from the TNPCB as per the Solid Waste Management Rules, 2016.
