40. Learned counsel for the appellants vehemently argued that the order on sentence imposed by the learned Sessions Judge considering the relationship between the accused/appellants and PWs.1 and 5 are concerned on the higher side and harsh one. Further submitted that there was a long standing enmity between them regarding partition of family property and under sudden provocation the scuffle was taken place but accused No.1 did not have any intention to kill PW.5 and it was rightly observed by the trial Court in acquitting accused Nos.1 and 2 under Section 307 of IPC, but at the same time the sentence imposed under Section 326 is on the higher side. Therefore, requested to reduce the sentence imposed by the trial court. On the other hand, the learned HCGP opposed reducing the sentence.
