The issue involved is with regard to the sustainability of Ext.P15 order passed by the third respondent, whereby the existing lease arrangement executed between the petitioner and the 2nd respondent was put an end to, for the lapse on the part of the petitioner in effecting the construction, forming the subject matter of lease.
2. The sequence of events as narrated in the writ petition shows that Ext. P1 lease deed was executed between the petitioner Zoom Infra Developers Pvt. Ltd and the second respondent on 27.10.2006, pursuant to which a separate Tripartite Agreements were executed for meeting the requirements, for obtaining financial assistance as well as with regard to the sub lease of the property to the subsidiary of the company by name 'Zoom Infra Developers Pvt. Ltd'. This was followed by a supplementary Agreement so as to settle the W.P. ) No.16725 OF 2012 rights and liberties for completing the work. Subsequently, the petitioner was served with Ext.P6 show cause notice dated 24.09.2010 asking to show cause, why the Lease Deed shall not be terminated for not honouring the commitment as per the terms of the Lease Agreement. It is stated that the petitioner replied pointing out the facts and figures vide Ext.P7. This was followed by Ext.P8 show cause notice; to which also, the petitioner submitted a reply as borne by Ext. P9. It was in the course of subsequent developments, that the petitioner was served with Ext.P15, whereby the lease was terminated by the second respondent for the default on the part of the petitioner, which forms the subject matter of challenge in this writ petition.
