This petition has been filed under Section 482 Cr.P.C. praying for the quashing of cross case FIR No.46 dated 22.01.2021 registered under Sections 148, 149, 323, 452, 506, 120-B of Indian Penal Code at Police Station City Sonepat (Annexure P-1) and all the subsequent proceedings emanating therefrom on the basis of compromise (Annexure P-2).
Brief facts of the case are that on 21.01.2021 the petitioners allegedly entered into the house of the complainant holding sticks (Dandas) and others weapons with them and gave beatings to the complainant and his parents.
In pursuance of the said order, the report of Chief Judicial Magistrate, Sonepat, forwarded vide letter no. 2178 dated 01.03.2023 has been submitted, which is already on record. The relevant part of the report is reproduced hereinbelow:-
"In these circumstances, it is concluded that the statements of the parties are bona fide and are not result of any threat, duress or coercion in any manner and hence compromise effected between the parties is genuine, voluntarily and without any coercion or undue influence and is valid one.
ii) In the abovesaid FIR No.46 dated 22.1.2021 under Sections 148, 149, 323, 452, 506, 120-B of IPC, PS City, Sonepat, IO of the present case appeared and suffered a statement, which is Annexure-IV (Annexed herewith in original). As per statement of I.O./ HC Rakesh Kumar no.1058/Spt, Court complex, chowki Gohana, in the present case bearing FIR No.46 dated 22.1.2021 under Sections 148, 149, 323, 452, 506, 120-B of IPC, PS City, Sonepat there are eight accused namely Shubham, Rahul Rana, Tarun, Ayush, Ashish, Prince Kumar, Suraj Kumar and Harshit.
There is no other case registered against them in his knowledge and Aman s/o Rajbir is the only victim/complainant in the present FIR. There is no proclaimed person in FIR No.46 dated 22.1.2021 under Sections 148, 149, 323, 452, 506, 120-B of IPC, PS City, Sonepat."
In compliance with the order dated 16.01.2023, status report on behalf of respondent No.1-State has filed, which is already on record, wherein it is sated that the matter is at the stage of framing of charge and further the petitioners are not involved in any other case.
