The appellant faced trial for the offence punishable under Section 306 Indian Penal Code (for short 'IPC') for abetting his wife Manjit Kaur @ Gian Kaur who committed suicide due to his cruel behaviour and his illicit relations with one Shanti (Accused No.2-acquitted by the trial Court).

As per the case of prosecution, the appellant got married with Manjit Kaur @ Gian Kaur about 14/15 years before her death on the intervening night of 12/13.09.2000. Manjit Kaur consumed some poisonous substance to end her life. The case was got registered by the brother of the deceased.

Dr. Rajnish Kumar PW1 had conducted the post-mortem examination of the dead body of Gian Kaur @ Manjit Kaur on 14.09.2000 and the cause of death was found to be the consumption of aluminum phosphide, a poison.

After completion of prosecution evidence, the statement of appellant was recorded, wherein he denied the allegations levelled against him but came up with no explanation for the death of his wife due to consumption of poison.

"The oral evidence produced by the parties i.e. the evidence of PW4 and PW6, establishes that a compromise was effected between Buta Ram and Smt. Gian Kaur deceased. In that compromise Buta Ram assured and undertook not to harass Gian Kaur in furture and also not to visit Shanti accused. Mark-A corroborates this oral account regarding the compromise dated 09.07.2000. Even if we ignore Mark-A, even then there is evidence on the file that a compromise was effected between Buta Ram accused and Gian Kaur deceased. The compromise established these facts:-
a) Buta Ram accused used to maltreat Gian Kaur.
                               b)           Buta Ram used to visit another woman.
                               c)           Buta Ram accused undertook not to harass the
deceased and also not to visit his paramour. But name of the lady having relations with Buta is not mentioned in Mark-A. However, Shanti accused was not a party in that compromise."
