31. The 'essential qualifying criteria' under the earlier tender were identical to the criteria stipulated under the impugned tender. Both the petitioner and respondent no.6/RVNL, along with other entities, submitted their bids under the earlier tender. In support of its bid in the earlier tender, respondent no.6/RVNL submitted a Performance Certificate dated 21st October 2022 issued by the South-Central Railway.
