Opposite party No.2 has lodged an FIR against six accused including the present applicant, being Case Crime No.1019 of 2018 dated 04.09.2018, levelling allegation of fraud, cheating and criminal breach of trust with an averment that they have realised money on the pretext of securing job in the Railway Department and, accordingly, issued a forged joining letter and confirmation letter in favour of twenty one (21) aspirants from whom they have extorted money total about one crore.
4. It is submitted that false and malicious prosecution has been instituted against the present applicant just to exert pressure upon him so that he may not raise previous financial transactions which took place between the present applicant and opposite party No.2 wherein applicant himself has given some money to the opposite party no.2. It is further submitted that story as portrayed in the FIR is incorrect and there is no evidence on record to prove that present applicant has extorted money from those 21 persons whose names are mentioned in the FIR on the pretext of securing job in the Railway Department.
