This petition has been filed under Article 226/227 of the Constitution of India for issuance of writ in the nature of mandamus directing the respondents to release the balance payment of Rs.40,51,084/- qua the works, which was allotted to the petitioner.

During the year 2015 to 2017, the petitioner was allotted the works of Lining of W/C O/L of various Rds as mentioned in para No.2 of the petition. The petitioner has completed the said work to the satisfaction of the respondents, but the payment thereof has not been released to him till date. In this regard, the petitioner has served a legal notice dated 03.01.2018 (Annex. P-2) but no action has been taken thereon till date. In view of the above position, this petition at this stage is being disposed of without expressing any opinion on the merits of the case, by giving a direction to respondent Nos. 2 & 3 to look into the 1 of 2 ::: Downloaded on - 11-02-2018 22:20:58 ::: CWP No. 2441 of 2018 2 legal notice of the petitioner (Annex. P-2) and decide the same in accordance with law, within a period of one month from the date of receipt of certified copy of this order. If respondent Nos. 2 & 3 come to a conclusion that the petitioner is entitled to the amount mentioned above, the same be released forthwith.
