1. The present appeal has been filed under Section 378(4) Cr.P.C. by the appellant/complainant against the judgement dated 28.02.2022 passed by learned JMFC, NI Act, THC in the case bearing CC No.530818/16 titled as 'ARSH KUMAR v. MAHARISHI NIRMAN PVT. LTD. & ANR.' vide which the respondent No.2 & 3 were acquitted of the offense under Section 138 NI Act. The appellant had approached this Court vide CRL.L.P. No.274/2022 seeking leave to appeal and the same was granted by this Court vide order dated 02.02.2023, following which the appeals were duly admitted.
