1. A petition under Section 278 of the Indian Succession Act for grant of Letter of Administration in respect of the immovable property of Late Sh. Kewal Krishan Parwanda has been filed.
2. In brief the facts stated in the petition are that Sh. Kewal Krishan Parwanda (hereinafter referred as 'the deceased') was resident of 61/8, Ashok Nagar, New Delhi died intestate on 03.04.2014 and the true copy of death certificate has been filed with the petition. The ordinary place of residence of the deceased, who was a Hindu governed by the Hindu Succession Act at the time of death was at Delhi.
7. Petitioners in order to prove their case examined petitioner No.1 Sh. Roby Parwanda as PW-1 and closed their evidence on 07.07.2018.
8. I have heard ld. counsel for petitioners Ms. Sonia Saini and perused the record.
9. Petitioner No.1 Sh. Roby Parwanda appeared as PW-1 and tendered his evidence by way of affidavit Ex.PW-1/A. He also proved the copy of death certificate of his father Ex.PW-1/1 and property documents as Ex.PW-1/2. He also proved the Schedule of legal heirs and properties as Ex.PW-1/3 and valuation report as Ex.PW-1/4.
10. The testimony of both PW-1 remained unrebutted as petition is not contested. Hence, on the basis of testimony of PW-1 the petitioners are entitled for grant of Letter of Administration in respect of property No. 30/2, Double Storey, Ashok Nagar, New Delhi-110017.
11. In the light of above discussion and observation, petitioners are entitled to letter of administration in respect property bearing No. 30/2, Double Storey, Ashok Nagar, New Delhi-110017 on furnishing Administration bond cum surety bond of Rs. 1,11,97,879/- as agreed by the petitioners.
