2. By means of this application, the applicant Kripa Shanker Pandey @ Kripa Nand Pandey is seeking enlargement on bail in Special Sessions Trial No. 68 of 2011, State Vs. Dilip Mishra and others arising out of Case Crime No. 237 of 2010 under Sections 302, 307, 427, 429, 120B I.P.C. and Section 3/5 of Explosive Substance Act and Section 7 Criminal Law Amendment Act and Section 2/3 (1) U.P. Gangsters & Anti Social Activities (Prevention) Act, 1986, Police Station Kotwali, District Allahabad during the pendency of trial.
24. Considering all the facts and circumstances of the case and the submissions advanced by learned counsel for the applicant, learned A.G.A. for the State and learned counsel for the complainant and without expressing any opinion on the merits of the case, I find it to be a fit case for bail.
25. Let applicant Kripa Shanker Pandey @ Kripa Nand Pandey involved in Case Crime No.237 of 2010 (Special Sessions Trial No. 68 of 2011) under Sections 302, 307, 427, 429, 120B I.P.C., Section 3/5 of Explosive Substance Act, Section 7 of Criminal Law Amendment Act and Section 2/3 (1) of U.P. Gangsters Act and Anti Social Activities (Prevention) Act, 1986, Police Station Kotwali, District Allahabad be released on bail on his executing a personal bond and furnishing two heavy sureties each in the like amount to the satisfaction of the court concerned subject to the following stringent conditions:-
