During the pendency of the present petition, the learned counsel for the petitioner prays for a direction from this Court to restrain the respondent no.2 from moving the Permanent Court of Arbitration at Hague for appointment of the 3rd Arbitrator. The petitioner submits that in view of the agreement between the Union of India, Oil and Natural Gas Corporation Limited, on the one hand, and the petitioner, i.e. Hindustan Oil Exploration Company Limited, and respondents, i.e. Invenire Petrodyne Limited and Hardy Exploration & Production (India) Inc., on the other hand, it will be this Court who will be entitled to appoint the third Arbitrator.
