In his cross examination by Ld. Counsel for accused Kamaljeet Kaur, he stated that he cannot tell the time on which the employees of airlines came to PS for handing over the accused. He volunteered that the FIR was given by DO. He denied the suggestion that he had arrested the accused at Taxi Stand of IGI Airport. He denied the suggestion that DO had not handed over the accused to him. He had made investigation from the persons mentioned in the list of witnesses. He admitted that he had not called the complainant Captain Surender Khajuria/ the complainant for any investigation. He had also not interrogated Jatinder Dhillon during the investigation. He had not sent any notice to owner of the passport Jatinder Dhillon to enquire how she left the passport and not enquired about it. He admitted that he had not procured any documents from airport or airlines during investigation, which bears the signatures of accused. At this stage, witness was confronted with judicial file and he admitted that no documents are found on record which he had procured from airlines and airport FIR NO.: 448/96 POLICE STATION: IGI Airport U/S: 419/420/468/471 IPC. 6 of 9 during the investigation which bears the signatures of accused except the documents prepared by him during investigation.

He denied the suggestion that he had arrested the accused for saving the actual culprit. He further denied the suggestion that accused had come to airport as his brother was departing for Australia and he had arrested her far from the airport near a taxi stand. He admitted that he had not made any public witness at the time of arrest of the accused. He admitted that he had not recorded the statement of complaint U/sec. 161 Cr.PC and had not conducted the TIP of the accused. Except the disclosure statement, he had not procured any document to confirm whether the accused is the similar person who was traveling to USA as stated by the complainant. He volunteered that accused Kamaljeet Kaur was produced by airline official in the PS IGI Airport and he arrested her from the police station.

The investigation in the present case is also faulty and does not inspire confidence. The matter was registered by DO on the direction of SHO given on complaint. The IO never visited the spot and had not inquired the matter from the complainant during the entire investigation. He also not made any effort to interrogate the real passport holder Jatinder Dhillon to bring out the truth. The IO(PW5) has also not made any effort to procure any document from the airlines bearing the signatures of accused to establish her identity.
