5.1. I state and submit that respondent no. 1, being a statu- tory entity, is bound to operate within the confines of the AMASR Act, 1958. Any deviation from the powers and func- tions prescribed under the statute, would constitute an unau- thorized exercise of jurisdiction. It is to note that under the provisions of the AMASR Act, 1958, construction within the Regulated Area of a Centrally Protected Monument is prohib- ited without the prior recommendation of respondent no. 1.
